TikTok is running out of options to stave off a looming U.S. ban. But one of TikTok's few remaining sources of hope has just emerged. The U.S. Supreme Court has agreed to hear TikTok's arguments against the upcoming ban. Here are the details.
US Supreme Court to Hear TikTok Case on January 10
Under legislation passed by the US Congress and signed by President Biden, TikTok will soon be banned in the US unless ByteDance sells its stake in the US social app.
So far, ByteDance's various lawsuits have gone nowhere.
But there is another legal way to stave off the looming ban: the US Supreme Court.
Today, the Supreme Court formally agreed to hear the case on Friday, January 10, 2025.
A total of 1,000 people were heard during oral arguments from the representatives TikTok and its legal opponents will be given two hours.
Each side must also meet several deadlines in advance.
According to the Supreme Court memorandum:
The parties are directed to simultaneously file electronically their opening briefs, limited to 13,000 words, and a joint exhibit no later than 5:00 p.m. (EST) on Friday, December 27, 2024. Reply briefs, limited to 6,000 words, must be filed electronically no later than 5:00 p.m. (EST) on Friday, January 3, 2025. All amicus curiae briefs must be filed electronically no later than 5:00 p.m. (EST), Friday, December 27, 2024.
The January 10 hearing date doesn't provide much of a cushion before the January 19 deadline.
It's possible the Supreme Court will speed up its decision after the January 10 hearing, but it would still be unusual for a decision to be issued so soon.
Another factor in this debate is President-elect Donald Trump, who has signaled that he may try to overturn the ban if possible. He will be inaugurated the day after the January 19 deadline.
Either way, the Supreme Court's involvement is good news for TikTok and owner ByteDance. It means there's still hope for their case.
