A court in British Columbia, Canada, today approved an Apple settlement related to the 2018 iPhone battery regulation dispute, CBC News reports.
Apple has agreed to pay up to C$14.4 million to settle a class action lawsuit in Canada that alleged the company secretly limited the performance of some iPhone models. Each affected customer who files a claim will receive a payout from Apple ranging from C$17.50 to C$150, with the exact payout amount depending on the total number of claims filed. More information on how to file a claim will be posted on the settlement website, but specific timelines have not yet been specified.
The class includes all current or former residents of Canada (excluding Quebec) who owned and /or purchased an iPhone 6, iPhone 6 Plus, iPhone 6s, iPhone 6s Plus and/or iPhone SE with iOS 10.2.1 or later installed or downloaded and/or iPhone 7 or iPhone 7 Plus with iOS 11.2 or later installed . or uploaded before December 21, 2017. According to CBC News, a serial number will be required for each affected iPhone.
Apple has denied the allegations outlined in the lawsuit, and the settlement is not an admission of guilt. The settlement allows Apple to avoid additional time and costs associated with ongoing litigation.
In 2018, Apple was sued in several Canadian provinces over iPhone battery charge limits, including Alberta, British Columbia, Ontario and Saskatchewan. The lawsuits come shortly after Apple said it had begun limiting the maximum performance of some iPhone models with “chemically aged” batteries when necessary to prevent devices from unexpectedly shutting down. Apple introduced this new power management system in iOS 10.2.1, but initially did not mention the change in the release notes for this update, which caused a public outcry. Apple eventually apologized for the lack of transparency and temporarily reduced the price of iPhone battery replacements to US$29 for the rest of 2018.
Apple agreed to pay up to US$500 million to settle the dispute. There is a similar class action lawsuit in the US, and payments there began to be made in January.
